1.Definitions:
1.1. The Club: as indicated on the application form.
1.2. The Club Rules:The rules and regulations of the club, as amended from time to time, displayed at the club reception.
1.3. The Laguna Health & Spa
2. Membership Applications:
2.1. Persons wishing to become members of the club shall complete the Membership Application Form and submit it to The Laguna.The Laguna reserves the right to reject any application for membership without giving any reason for so doing. By signing the Membership Application Form the member agrees to comply with these Terms and Conditions of Membership and the Club Rules.
3. Membership Definitions:
3.1. The Laguna offers the following categories of membership, please note, not all categories are available at all clubs:
Full: For a person 16 years or over, unlimited use of facilities during opening hours.
Joint: Two adults paying by a single monthly DD or annual payment, unlimited use of facilities during opening hours.
Off Peak: Use of club is limited to the times published in the club.
Over 55: For a person aged 55 and over. Unlimited use of facilities during off peak hours.
Student: For a person under 25 years in full time education, unlimited use of facilities during opening hours.
Corporate/Group: A minimum of five named employees or group members from a single organisation unlimited use of facilities during opening hours. (The Laguna reserves the right to decline applications).
Corporate Membership: The member may transfer his/her Corporate Membership to another employee of the same employer on payment of the prevailing transfer fee. If the number of the other Member’s corporate group falls below the minimum number required for Corporate Membership, the membership subscriptions shall there upon automatically increase to the then prevailing rate for the individual membership.
Joint Membership: If the member’s joint member either ceases to be a member, or defaults in payment of his/her membership subscriptions, the membership subscriptions of the member shall thereupon automatically increase to the then prevailing rate for individual membership.
3.2. The Laguna offers the following types of membership:
Three Month MinimumTerm. Membership fees may be paid quarterly or by monthly direct debit. Once the initial three month period has expired the membership will then be on a rolling monthly basis. To terminate a membership one full calendar months notice must be given in writing to the Laguna Health and Spa. Twelve Month Minimum Term. Membership fees may be paid annually in advance or by monthly direct debit. Once the initial twelve month period has expired the membership will then be on a rolling monthly basis. To terminate a membership after this period one full calendar months notice must be given in writing to the Laguna Health and Spa.
4. Fees:
The Laguna will set the level of fees and reserves the right to change the level of fees from time to time. The following fees prevail:
4.1. Membership fee
The level of membership fees shall be determined according to the type and category of membership.
4.2. Joining fee/Activation charge
Upon joining the club all new members shall pay a joining fee or activation charge.
4.3. Guest user fee
A fee will be set by The Laguna from time to time in respect of guests of members who wish to visit the club and use the facilities.
4.5. Other Fees
All other fees and prices for the sale of goods at the club, locker rental, solarium, bar/restaurant and any other services will be set by The Laguna from time to time.
4.6. Membership Fees, Joining Fees, Activation Charge and Guest User Fees are not refundable by The Laguna under any circumstances unless you have enrolled on The Laguna induction programme.
4.7. Physical condition of member
Although the Proprietor will check the member’s blood pressure and resting heart rate on the occasion of the member’s initial induction to the club’s fitness suite, its employees and agents are not medically trained and its is the
member’s responsibility to satisfy himself/herself as to his/her physical condition through his/her own doctor before using the club’s facilities.
Save as otherwise notified by the member to the Proprietor in writing, the member confirmed that he/she is in good physical condition and that he/she is capable of engaging in active and passive exercise and that such exercise would not be detrimental to hi/her health, safety, comfort or physical condition. The member undertakes to notify the club’s membership administrator in writing should this confirmation cease to be accurate. The member, if female, acknowledges that if she is pregnant, is her responsibility to check with her own medical advisor which of the club’s facilities should not be used during her pregnancy or thereafter. Neither the Proprietor, nor the employees or agents of the Proprietor, shall be responsible for any death or personal injury occurring on the club premises, or as a result of the use of facilities and/or equipment provided by the Proprietor at the club., except to the extent that such death or personal injury arises from any negligent act or omission of the Proprietor or any employee or agent of the Proprietor.
5. Suspension of Membership:
A member may, if he/she is unable to make use of the club by reason of illness, injury or temporary relocation suspend the membership for a minimum term of one month and a maximum of six continuous months. To suspend a membership one calendar months notice must be given in writing to the Laguna Health and Spa. A member cannot suspend the membership during the first three months of the agreement. The amount of time on freeze will then be added onto the remainder of the agreement. A reduced monthly fee will be charged during the suspension of the membership.
6. Termination of Membership by The Laguna:
The Laguna reserves the right to terminate membership:
6.1 without notice in the event of repeated or serious breach of the Club Rules or the Membership Terms and Conditions;
6.2 on at least 7 days' notice in writing, in the event of any other breach of the Club Rules or the Membership Terms and Conditions, including, but not limited to, the non-payment of any fees owing to The Laguna within 14 days of their due date.
7. Guests:
7.1. Guests accompanied by a member will be admitted on payment in advance of the Guest Fee.
7.2. Members who wish to be accompanied by more than 2 guests must book with the club in advance.
7.3. Members must accompany their guests at all times and members shall not leave the club premises before their guests.
7.4. All guests must sign the guest book and the appropriate Physical Activity Readiness Questionnaire.
7.5. The Laguna reserves the right to refuse admission to a guest for reasons of health and safety or if the proposed guest has previously not complied with the Club Rules.
8. Membership Card:
8.1. Membership cards shall be issued to all members upon joining the club and are to be used to gain entry to the club. Membership cards are not transferable and any members allowing their card to be used by another person is in serious breach of these Membership Terms and Conditions and will entitle The Laguna to terminate membership without notice in accordance with Clause 6 above.
8.2. If a membership card is lost, it should be reported to The Laguna and The Laguna reserves the right to charge an administration fee for the provision of a replacement membership card.
9. Data Protection
To ensure that the member maximises his/her benefit of Membership, the Proprietor would like to be able to contact the member if he/she has not attended the club recently to offer encouragement or to contact the member to seek his/her opinion as to how the level of service at the club might be improved or ask him/her to complete a member
satisfaction survey.
The Proprietor would also like to be able to send to the member any club magazine or other publication which the Proprietor might periodically produce and/or information on forthcoming promotions, events, classes, timetables and such other benefits, offers, products or services to which he/she may be entitled, or in which he/she may be interested as a member of the club.
The member should indicate in the box on the front page of this membership agreement whether or not he/she consents to the Proprietor contacting him/her for this purpose.
10. Miscellaneous:
10.1. Where applicable,The Laguna reserves the right to alter the operating, off-peak access hours of the club, provided that The Laguna shall always attempt to give at least 30 days notice to all members of any permanent change in these hours.
10.2. The Laguna reserves the right to adjust the availability of certain facilities on a temporary basis for the general purpose of cleaning, decorating, essential repairs, maintenance of equipment, special functions and holidays.
